Terms of Service
The terms that apply when you use the Chessware website, dashboard, apps and Discord server, including purchases, licenses and acceptable use.
Last updated: 28 October 2026
These Terms of Service ("Terms") are an agreement between you and [Company legal name] ("we", "us", "our"). They apply when you use our website at https://chessware.net, your dashboard, Chessware, Chessware Lite, our Discord server and any related services (together, the "Services").
By signing in to or using the Services, you agree to these Terms. If you don't agree, don't use the Services.
These Terms work together with:
- our End-User License Agreement ("EULA"), which covers your use of the software;
- our Acceptable Use & Fair Play policy;
- our Refund Policy; and
- our Privacy Policy, which explains how we handle your personal data.
1. Who we are
The Services are provided by [Company legal name]. You can contact us at [support email] or in our Discord server at https://discord.gg/kCTeGtzywj.
2. Eligibility
You must be at least 13 years old, or the minimum age of digital consent in your country if that is higher, to use the Services. Because you sign in with Discord, you must also meet Discord's own age requirements.
If you are under 18, or under the age of legal majority where you live, you may only make purchases with the permission of a parent or legal guardian. By giving permission, your parent or guardian agrees to these Terms on your behalf and is responsible for your purchases and use of the Services.
You may not use the Services if the laws that apply to you prohibit it.
3. Your account
You sign in with Discord. Signing in for the first time creates your Chessware account and links it to your Discord account. We never receive or store your Discord password.
You are responsible for:
- keeping your Discord account secure, including using any security features Discord offers;
- all activity that happens through your Chessware account; and
- telling us promptly at [support email] if you think someone else has accessed your account or license key.
Your account is personal to you. You may not share it, sell it or let anyone else use it.
When you sign in, you receive the Member role in our Discord server, and purchases add further roles, as described in our documentation.
4. Purchases and pricing
You must be signed in to make a purchase.
- Prices and plan details. Prices, currencies and plan details, such as the length of the license, are shown before you pay. The details shown at checkout form part of these Terms for that purchase.
- Taxes. Prices may include, or be subject to, taxes such as VAT, GST or sales tax, as shown at checkout.
- Payment. Payments are processed by Stripe. By completing checkout, you authorize the charge shown. We never see or store your full card number. Stripe's own terms and privacy policy apply to how it processes your payment.
- One active license at a time; extra keys wait in your inventory. Only one license on your account is active at a time. A license is active until it expires or is revoked, including a key you haven't used in Chessware yet. If you buy or redeem a key while you have an active license, the new key goes into your inventory in the Licenses tab of your dashboard. A key in your inventory hasn't started: its time doesn't run, it isn't locked to a PC and Chessware won't accept it until you activate it. You can activate a key from your inventory once you no longer have an active license.
- Delivery. After a successful payment, a license key is issued to your account and appears in your dashboard. Your order and receipt appear in the Transactions tab.
- Price changes. We may change prices for future purchases. Changes don't affect purchases you've already paid for.
- Errors. If a price or plan is listed incorrectly because of an obvious error, we may cancel the order and refund you in full.
5. Licenses
Chessware and Chessware Lite are licensed to you, not sold. Your use of them is governed by the EULA. In summary:
- each license key is personal and locks to the first PC that activates it;
- only one license on your account is active at a time, and other keys wait, unstarted, in your inventory (see section 4);
- a key's time starts at first activation, not at purchase;
- Chessware checks your license online when it starts and regularly while it runs; and
- license keys may not be shared, resold or transferred.
If you need to move your license to a new PC, you can ask our support team for a device reset.
6. Acceptable use and fair play
You must use the Services in line with our Acceptable Use & Fair Play policy. In particular, Chessware is for training and analysis. You must not use it to get assistance during live games on platforms or in events that forbid outside help, and you are responsible for following the rules of every platform and event where you play.
7. Suspension and termination
By you. You can stop using the Services at any time. You can delete your account in your dashboard under Account → Danger zone → Delete account. Deleting your account revokes and deletes all your license keys.
By us. We may suspend or close your account, revoke license keys, or remove you from our Discord server if:
- you break these Terms, the EULA or the Acceptable Use & Fair Play policy;
- you share, resell or misuse a license key;
- a payment is reversed, charged back or found to be fraudulent;
- the law requires us to; or
- your use creates a risk to the Services, to other users or to us.
Where reasonable, we'll tell you why and give you a chance to respond before we act. In serious cases, we may act immediately.
If we close your account or revoke a key because you broke these Terms, you are not entitled to a refund, except where the law requires one.
Any part of these Terms that by its nature should continue after your account ends, including intellectual property, disclaimers, limitation of liability, indemnity and governing law, continues to apply.
8. Refunds
Refunds are covered by our Refund Policy. Nothing in these Terms or the Refund Policy limits rights you have under the consumer protection laws where you live.
9. Intellectual property
The Services, including Chessware, Chessware Lite, our website, documentation, names, logos and related content, belong to us or our licensors and are protected by intellectual property laws. Apart from the limited rights granted in these Terms and the EULA, you get no rights in them.
You keep any rights you have in content you send us, such as messages to support. You allow us to use that content only as needed to provide the Services and to help you.
If you send us feedback or suggestions, you allow us to use them freely, without any obligation to you.
10. Third-party services
The Services rely on third parties, including Discord for sign-in and our community server, and Stripe for payments. Your use of those services is governed by their own terms and privacy policies. We aren't responsible for third-party services and can't guarantee they'll always be available. If Discord or Stripe is unavailable, parts of the Services may not work.
You may use Chessware alongside third-party chess platforms. We aren't affiliated with those platforms unless we say so, and their rules apply to your play there.
11. Changes to the Services
We may update, change or remove features of the Services from time to time, for example to improve them, fix problems or meet legal requirements. Some updates may be needed to keep using Chessware. We'll give reasonable notice of changes that significantly reduce what you've paid for.
12. Disclaimers
To the extent permitted by law, the Services are provided "as is" and "as available". We don't promise that the Services will be uninterrupted or error-free, that they'll meet every need, or that using Chessware will improve your results or rating. Analysis and explanations are provided for training and may contain errors.
Some places don't allow certain warranties to be excluded. If you are a consumer, you may have statutory rights that these Terms can't change, and nothing in these Terms affects them.
13. Limitation of liability
To the extent permitted by law:
- we are not liable for indirect, incidental, special or consequential losses, or for loss of data, profits, revenue, goodwill or opportunity, arising from or related to the Services; and
- our total liability to you for all claims relating to the Services is limited to the amount you paid us in the 12 months before the event that gave rise to the claim.
Nothing in these Terms limits or excludes liability that can't be limited or excluded by law, such as liability for death or personal injury caused by negligence, for fraud, or under mandatory consumer protection law.
14. Indemnity
To the extent permitted by law, you agree to indemnify [Company legal name] against claims, losses and costs, including reasonable legal fees, arising from your breach of these Terms, the EULA or the Acceptable Use & Fair Play policy, or from your misuse of the Services. This doesn't apply to the extent a claim was caused by us, and it doesn't limit your rights as a consumer.
15. Governing law and disputes
These Terms are governed by the laws of [country / state]. Disputes will be handled by the courts of [country / state], unless the law where you live gives you the right to bring proceedings there.
If you are a consumer, you keep the protection of any mandatory laws of the country where you live.
Before starting formal proceedings, please contact us at [support email] so we can try to resolve the issue informally.
16. Changes to these Terms
We may update these Terms from time to time. When we do, we'll change the "Last updated" date at the top of this page. If a change is significant, we'll tell you before it takes effect, through the website, your dashboard, our Discord server or by email. If you keep using the Services after a change takes effect, you accept the updated Terms. If you don't agree, you can stop using the Services and delete your account.
17. General
- Entire agreement. These Terms, together with the documents they link to, are the whole agreement between you and us about the Services.
- Severability. If any part of these Terms is found to be unenforceable, the rest stays in effect.
- No waiver. If we don't enforce a right straight away, we haven't given it up.
- Transfer. You may not transfer your rights under these Terms. We may transfer ours to an organization that takes over the Services, as long as your rights aren't reduced.
- Events outside our control. We aren't responsible for delays or failures caused by events beyond our reasonable control.
